Terms of service

Effective from 2026-10-30

§1. General provisions

  1. These Terms set out the rules for booking and using the MaxiGym private training room at pl. Defilad 1, 00-901 Warszawa (the “Room”).
  2. The Room and the maxigym.pl service are operated by MaxiGym Sp. z o.o., ul. Przykładowa 1, 00-001 Warszawa, NIP 0000000000, REGON 000000000, KRS 0000000000 (the “Operator”). Contact: biuro@maxigym.pl, +48 600 000 000.
  3. The Room is unstaffed. Entry is by a single-use PIN code assigned to a booking.
  4. By making a booking, the Client confirms they have read and accept these Terms.

§2. Definitions

  1. Client — an adult natural person with an account in the service who makes a booking.
  2. Companion — a person using the Room together with the Client under the Client’s booking.
  3. Booking — the exclusive right to use the Room during the chosen time slot.
  4. PIN code — the code that opens the Room’s door, valid only during the Booking.
  5. Client account — the logged-in part of the service where the Client sees their bookings and codes.

§3. Account and eligibility

  1. Only persons aged 18 or over may create an account. The Client provides true details and does not share the account.
  2. Persons aged 13–17 may be in the Room only as Companions, in the presence of the Client, who is responsible for them. Children under 13 may not use the Room.
  3. The Client may delete the account at any time in the Client account (“Delete account”) or by writing to biuro@maxigym.pl. The account cannot be deleted while the Client has an upcoming paid Booking or unused hours in a valid Package — first cancel the Booking (§6) or use or return the Package (§6a). Unused bonus hours and free hours are lost when the account is deleted (§6b, §6c).

§4. Booking and payment

  1. The Room can be booked daily between 6:00 and 24:00, in whole hours (1 to 6 consecutive hours), up to 14 days ahead.
  2. The price depends on the day of the week and the time of day (the lower rate applies Monday to Friday in the morning and daytime hours) and is shown in the price list and when choosing a slot. Prices are gross and cover the whole Room regardless of the number of people (subject to §5(1)).
  3. A chosen slot is held for 30 minutes. If payment is not completed within that time, the slot is released.
  4. Payment is made in advance through a payment operator (BLIK or payment card). The contract is concluded when payment is confirmed; the Client receives a confirmation by e-mail.

§5. Using the Room

  1. A maximum of 3 people may be in the Room at the same time (the Client and up to two Companions, including a personal trainer).
  2. The PIN code appears in the Client account 12 hours before the Booking starts and works from the start until the end of the Booking (before that, the previous Client may still be in the Room). The code must not be shared with anyone outside the booking.
  3. The Client is responsible for everyone they let into the Room with their code, as for their own actions.
  4. Arriving late does not extend the Booking. The Client leaves the Room no later than the end of the Booking, so that the next person can start on time.
  5. Before using a machine, the Client reads its instructions or pictogram and checks it for visible damage. Loads are chosen according to the Client’s abilities.
  6. Heavy free-weight exercises (e.g. bench press, barbell squat) are performed only with a spotter or using the rack’s safety bars.
  7. The Room must not be used by anyone who feels unwell, is ill, or is under the influence of alcohol, drugs or medication that impairs performance.
  8. When leaving, the Client puts the equipment back, turns off the music and closes the door, checking that the lock has engaged.
  9. If the code does not open the door, the Client contacts the Operator immediately at +48 600 000 000. If the problem cannot be solved, the Operator refunds the full price of the Booking or — at the Client’s choice — offers another slot.

§6. Cancellations and refunds

  1. The Client may cancel a Booking free of charge in the Client account no later than 12 hours before it starts. The full amount is returned to the Client’s payment account within 14 days.
  2. A Booking cancelled less than 12 hours before it starts, or not used, is not refundable.
  3. If the Operator cannot make the Room available (e.g. a breakdown, maintenance, force majeure), it informs the Client and refunds the full price or — at the Client’s choice — moves the Booking to another slot.
  4. A Booking is a leisure and sports service provided on a specified date. Under Art. 38(1)(12) of the Polish Consumer Rights Act, the Client has no right to withdraw from a distance contract; cancellations are governed by paragraphs 1–3.

§6a. Hour package

  1. A Package is 10 hours of using the Room for 490 zł gross, usable at any time during opening hours, for 3 months from the date of purchase.
  2. The Package is bought in the Client account and paid in advance (BLIK or payment card). The contract is concluded when payment is confirmed.
  3. The Client pays for Bookings in the calendar with Package hours under §4, choosing “Your hours”. One Booking is paid from one Package.
  4. A Booking paid with Package hours may be cancelled in the Client account no later than 12 hours before it starts — the hours then go back to the Package. If the Booking is cancelled later or not used, its hours are lost.
  5. Hours not used within the Package’s validity period are lost. The validity period is not extended and unused hours are not refunded, subject to paragraph 6.
  6. A consumer may withdraw from the Package purchase without giving reasons within 14 days of the contract — in the Client account (“Refund unused hours”) or by writing to biuro@maxigym.pl. By booking Package hours before that period ends, the Client requests that the service start before the withdrawal period expires; on withdrawal the Client then pays for the hours used until that moment (Art. 35 of the Polish Consumer Rights Act), and the Operator refunds the amount corresponding to the unused hours (49 zł per hour) within 14 days, by the same payment method.
  7. Before withdrawing, the Client cancels upcoming Bookings paid with the Package.
  8. A Client who withdrew from a Package may conclude a new Package contract no earlier than 90 days after the withdrawal. This does not limit using the Room under §4.

§6b. Monthly challenge (loyalty programme)

  1. A Client who trained on a set number of different days in a calendar month receives free hours of using the Room (“Bonus hours”) in the following month. Paid Bookings that took place count; Bookings paid with Bonus hours do not.
  2. The required number of days and of Bonus hours for a month are announced by the Operator in the Client account no later than the first day of that month; during the month they do not change to the Client’s disadvantage. Unless announced otherwise: 12 days — 1 hour.
  3. The reward is granted once per month, regardless of the number of sessions. Bonus hours appear in the Client account at the start of the following month.
  4. Bonus hours can be used at any time of day, booked in the calendar like Package hours (§6a(3)–(4)), until the end of the month in which they were granted. If unused, they are lost.
  5. Bonus hours have no cash value and cannot be exchanged for money, refunded or transferred to another person.
  6. The Operator may refuse Bonus hours in case of abuse (e.g. Bookings made only to obtain them) and may end the programme with at least 30 days’ notice; Bonus hours already granted remain valid.

§6c. Free hours

  1. The Operator may grant the Client free hours of using the Room (e.g. as compensation or as part of a promotion). They are shown in the Client account.
  2. Free hours are valid for 1 month from the day they are granted and can be used at any time of day, booked in the calendar like Package hours (§6a(3)–(4)). When booking, the hours that expire first are used first.
  3. Unused free hours are lost when they expire. They have no cash value and cannot be exchanged for money, refunded or transferred to another person.

§7. House rules

  1. Clean indoor sports shoes, changed at the entrance, and your own towel are required.
  2. After training, the Client wipes the equipment used with the disinfectant provided.
  3. It is forbidden to bring in or consume alcohol or drugs, smoke (including e-cigarettes), bring animals, drop or throw equipment, take equipment out of the Room, or stay in the Room outside the Booking.
  4. Music may be played on the Room’s speaker at a moderate volume, with consideration for neighbours.
  5. Damaged or faulty equipment must not be used. The Client reports the fault to the Operator by e-mail or phone, preferably with a photo, if possible still during the Booking.
  6. In an accident or emergency, call 112 first, then inform the Operator. A first-aid kit and emergency instructions are located at the entrance to the Room.
  7. The Client does not leave valuables in the Room. The Operator is liable for the Client’s belongings under general rules.

§8. Health and safety

  1. Everyone in the Room trains at their own risk, judging their own health, skills and choice of loads. The Operator recommends a medical check before starting training and using a spotter for heavy lifts.
  2. The Client informs Companions of these Terms before entering the Room.
  3. When creating an account, the Client declares that their health allows unsupervised strength and endurance training. If in doubt, the Client consults a doctor before training.
  4. The price does not include accident insurance. The Operator recommends that everyone training has their own personal accident (NNW) insurance.
  5. The Operator is not liable for damage caused solely by a breach of these Terms, equipment instructions or safe-training rules by the Client or Companions, by third parties for whom the Operator is not responsible, or by force majeure — unless the Operator contributed to the damage.
  6. If the injured person contributed to the damage or its extent, the obligation to compensate is reduced accordingly (Art. 362 of the Polish Civil Code).
  7. The above does not exclude or limit the Operator’s liability for personal injury, for damage caused intentionally or through gross negligence, or in any other respect where the law does not allow it.

§9. Liability for damage

  1. The Client is liable, under general rules, for damage to the Room and equipment caused by them or their Companions — up to the amount of the actual damage.
  2. The Client reports damage to the Operator by e-mail, preferably with a photo, by the end of the day on which it was noticed. To establish what happened, the Operator may use CCTV recordings and the door-opening log.
  3. The Operator does not apply contractual penalties to consumers — the Client covers only the documented cost of repair or replacement.

§10. CCTV

  1. The entrance and the training room are covered by video monitoring without sound. The changing room and toilet are not monitored.
  2. Recordings are kept for 14 days, or until an incident is resolved. Details are in the Privacy Policy.

§11. Account suspension

  1. The Operator may suspend booking in the event of a serious breach of these Terms, in particular sharing the code with third parties, letting in people who are not allowed in the Room, wilful damage to equipment or repeatedly overstaying a Booking.
  2. The Operator informs the Client of the suspension and its reason by e-mail. Paid bookings cancelled as a result are refunded, unless the breach concerned that booking.

§12. Complaints

  1. Complaints can be sent by e-mail to biuro@maxigym.pl, with the Client’s details, the booking date and a description of the problem.
  2. The Operator replies within 14 days. No reply within that time means the complaint is accepted.
  3. A Client who is a consumer may use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman.

§13. Personal trainers running a business

  1. A trainer booking the Room as part of their business is responsible for their clients as the Client is for Companions, and makes sure they have read these Terms.
  2. The trainer holds valid business liability insurance and shows proof of it at the Operator’s request.
  3. Detailed terms of regular cooperation (fixed slots, settlements, invoices) may be set out in a separate agreement.

§14. Final provisions

  1. The Operator may amend these Terms for important reasons: changes in law, changes in how the Room or the booking system operates, price changes, or safety needs. Changes are announced on the website and by e-mail at least 30 days before they take effect; a Client who does not accept them may delete their account during that time. Changes do not apply to bookings paid for earlier.
  2. Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

In your browser’s storage (localStorage) we keep only a few display settings: that you closed the hint about installing the app, that your account already has a first training behind it (to know when to show that hint) and — only until the tab is closed — a note about a new record in the journal. They never reach our server and you can delete them in your browser settings.
