§1. General provisions
- These Terms set out the rules for booking and using the MaxiGym private training room at pl. Defilad 1, 00-901 Warszawa (the “Room”).
- The Room and the maxigym.pl service are operated by MaxiGym Sp. z o.o., ul. Przykładowa 1, 00-001 Warszawa, NIP 0000000000, REGON 000000000, KRS 0000000000 (the “Operator”). Contact: biuro@maxigym.pl, +48 600 000 000.
- The Room is unstaffed. Entry is by a single-use PIN code assigned to the booking.
- By booking the Room, the Client confirms that they have read and accept these Terms.
§2. Definitions
- Client — an adult natural person who has an account in the service and makes a booking.
- Companion — a person who uses the Room together with the Client under the Client’s booking.
- Booking — the exclusive right to use the Room during the chosen time slot.
- PIN code — the code that opens the door of the Room, valid only during the Booking.
- Client account — the part of the service available after logging in, where the Client can see their bookings and codes.
§3. Account and eligibility
- Only persons aged 18 or over may create an account. The Client provides accurate details and does not share the account with anyone else.
- Persons aged 13–17 may be in the Room only as Companions, in the presence of the Client, who is responsible for them. Children under 13 may not use the Room.
- The Client may delete their account at any time in the Client account (“Delete account”) or by writing to biuro@maxigym.pl. The account cannot be deleted while the Client has an upcoming paid Booking or unused hours in a valid Package — the Client must first cancel the Booking (§6) or use up or return the Package (§6a). Unused Bonus hours and free hours are forfeited when the account is deleted (§6b, §6c). The Client confirms the deletion with their password or, for an account that signs in only with Google, by signing in with Google again.
§4. Booking and payment
- The Room can be booked every day between 6:00 and 24:00, in blocks of whole hours (1 to 6 consecutive hours), up to 14 days in advance. One account may make at most 10 Bookings in 24 hours; the Operator books more slots (e.g. a trainer’s regular hours, §13) at the Client’s request.
- The price depends on the day of the week and the time of day (the lower rate applies Monday to Friday in the morning and during the day) and is shown in the price list on the website and when choosing a slot. Prices include VAT and cover the whole Room, regardless of the number of people (subject to §5(1)).
- The Operator may introduce promotional prices for a period stated in the price list. The price of an hour is determined by the day of the booked slot, and the price of a Package by the day it is bought. The price shown at payment is final: paid Bookings and Packages keep their price even after a promotion ends or changes.
- A selected slot is provisionally held for 30 minutes. If payment is not completed within that time, the slot is released.
- Payment is made in advance through a payment operator (BLIK or payment card). The contract is concluded when payment is confirmed; the Client receives a confirmation by email.
§5. Using the Room
- No more than 3 people may be in the Room at the same time (the Client and up to two Companions, including a personal trainer).
- The PIN code appears in the Client account 12 hours before the Booking starts and works from the start to the end of the Booking (before then, the previous Client may still be in the Room). The code must not be shared with anyone outside the booking.
- Arriving late does not extend the Booking. The Client leaves the Room no later than the time the Booking ends, so that the next person can start on time.
- The Client is responsible for anyone they let into the Room with their code as if for their own actions.
- Before using any equipment, the Client reads its instructions or pictogram and checks it for damage. The Client chooses loads that match their abilities.
- Heavy free-weight exercises (e.g. bench press, barbell squat) may be performed only with a spotter or using the safety bars of the rack.
- The Room must not be used by anyone who feels unwell, is ill, or is under the influence of alcohol, drugs or medication that impairs their physical ability.
- When leaving, the Client puts the equipment back, turns off the music and closes the door, checking that the lock has engaged.
- If the code does not open the door, the Client contacts the Operator immediately on +48 600 000 000. If the problem cannot be resolved, the Operator refunds the full price of the Booking or — at the Client’s choice — offers another slot.
§6. Cancellations and refunds
- The Client may cancel a Booking free of charge in the Client account no later than 12 hours before it starts. The full amount is returned to the Client’s payment account within 14 days. Within 24 hours, the Client may use the Client account to cancel at most 5 Bookings with a refund of money or hours; further cancellations in that period are made by the Operator at the Client’s request (email or phone) on the same terms.
- A Booking that is cancelled less than 12 hours before it starts, or is not used, is non-refundable.
- If the Operator cannot make the Room available (e.g. due to a breakdown, maintenance work or force majeure), it informs the Client and refunds the full price of the Booking or — at the Client’s choice — moves it to another slot.
- A Booking is a leisure and sports service provided on a specific date. Under Art. 38(1)(12) of the Polish Consumer Rights Act, the Client has no right to withdraw from a contract concluded at a distance; cancellations are governed by paragraphs 1–3.
§6a. Hour package
- A Package is 10 hours of use of the Room at the price shown in the price list on the day of purchase (regular price: 490 zł including VAT), to be used at any time during opening hours within 3 months of the date of purchase.
- The Package is bought in the Client account and paid for in advance (BLIK or payment card). The contract is concluded when payment is confirmed.
- The Client uses Package hours to pay for Bookings in the calendar under §4 by choosing “Your hours”. Each Booking is paid from a single Package.
- A Booking paid with Package hours may be cancelled in the Client account no later than 12 hours before it starts — the hours then go back to the Package. If the Booking is cancelled later or not used, its hours are forfeited.
- Hours not used within the Package’s validity period are forfeited. The validity period is not extended and unused hours are not refunded, subject to paragraph 6.
- A consumer may withdraw from the Package purchase contract without giving a reason within 14 days of concluding it — in the Client account (“Refund unused hours”) or by writing to biuro@maxigym.pl. By booking Package hours before that period ends, the Client requests that performance of the service begin before the withdrawal period expires; if the Client then withdraws, they pay for the hours used up to that point (Art. 35 of the Polish Consumer Rights Act), and the Operator refunds the amount corresponding to the unused hours (the price paid for the Package divided by its number of hours, for each unused hour) within 14 days, using the same payment method.
- Before withdrawing, the Client cancels any upcoming Bookings paid with the Package.
§6b. Monthly challenge (loyalty programme)
- A Client who trains on a set number of different days in a calendar month receives free hours of use of the Room in the following month (“Bonus hours”). Paid Bookings that have taken place count towards this; Bookings paid with Bonus hours do not.
- The Operator announces the required number of days and the number of Bonus hours for a given month in the Client account no later than the first day of that month; during the month, these conditions do not change to the Client’s disadvantage. Unless announced otherwise: 12 days — 1 hour.
- The reward is granted once per month, regardless of the number of sessions. Bonus hours appear in the Client account at the start of the following month.
- Bonus hours can be used at any time of day by booking them in the calendar like Package hours (§6a(3)–(4)), until the end of the month in which they were granted. Unused Bonus hours are forfeited.
- Bonus hours have no cash value and cannot be exchanged for money, refunded or transferred to another person.
- The Operator may refuse to grant Bonus hours in the event of abuse (e.g. Bookings made solely to obtain them) and may end the programme by giving at least 30 days’ notice; Bonus hours already granted remain valid.
§6c. Free hours
- The Operator may grant the Client free hours of use of the Room (e.g. as compensation or as part of a promotion). They are shown in the Client account.
- Free hours are valid for 1 month from the day they are granted and can be used at any time of day by booking them in the calendar like Package hours (§6a(3)–(4)). When booking, the hours that expire soonest are used first.
- Unused free hours are forfeited when they expire. They have no cash value and cannot be exchanged for money, refunded or transferred to another person.
§6d. Training journal and VIP services
- In the Client account, the Client can keep a training journal free of charge: log workouts and plans, plan workouts up to 7 days ahead (to tick off in the Room; they count towards stats and records only on their day) and track their progress. The journal is an add-on to Bookings; the Operator may change or extend it.
- The Operator may give the Client VIP status — at its own discretion and at no extra charge — and may take it away. VIP status gives access to additional journal features (currently: adding exercises by voice, workout suggestions for today (“What to train?”) or the week, and the monthly summary), within daily limits set by the Operator — once a limit is used up, the feature is available again after 24 hours.
- Any Client can switch on the monthly summary by email, prepared with AI, in their Profile: it comes on the 1st of each month if they logged workouts on at least 2 different days in the past month. They can switch it off in their Profile or with the link in the email.
- Features marked “AI” use artificial intelligence, and those marked “BETA” are being tested: they may be interrupted, change or be switched off. Their results may contain mistakes — the Client checks them before saving them in the journal. The Client may hide each of them in Profile (Settings).
- Workout suggestions and summaries are for information only. They are not medical or physiotherapy advice or a plan prepared by a trainer, and do not replace them. The Client decides on their own training and loads (§8(1)).
- The Client may turn on “Friends” in the journal and invite other people who have an account in the Service — with a single-use link; whoever gets the link sees the inviter’s first name and the initial of their surname. Friends see only what the Client chooses: a summary of workouts (number of workouts, volume and sets per muscle group, and the training days of the last week) or also the best weights in exercises and their history (the best weight of each workout) and workout plans — without their names, with exercises from the common list — which a friend may copy to their own plans; friends also see the Client’s first name and the initial of their surname. A friend’s best weights show only when both of them show them. Friends can also: create challenges from ready-made templates (number of workouts, volume or sets over a chosen period) — their members, who are friends with each other, see each other’s results in the challenge; a friend may add the Client to a challenge, and the Client may leave it at any time; react to friends’ workouts and records with a ready-made 💪; and book the Room “with” up to two friends, who then see the day and hour of that Booking and which of its participants are also their friends (not its price, payment or door code). The feature has no messages or other text written by Clients — only numbers from the journals and a ready-made 💪. The Client may remove a friend or turn the feature off at any time. A comparison with friends can be saved as an image to share — with the results but without the friends’ names. The friend is responsible for how they use results shown to them (e.g. a screenshot or such an image).
- How journal data and the AI features handle personal data is described in the Privacy Policy.
§7. House rules
- Clean sports shoes, changed into at the entrance, and a personal towel are required in the Room.
- After training, the Client wipes down the equipment they used with the disinfectant provided.
- The following are prohibited: bringing in or consuming alcohol or drugs, smoking (including e-cigarettes), bringing in animals, throwing equipment, taking equipment out of the Room, and staying in the Room outside the Booking.
- Music may be played on the Room’s speaker at a moderate volume, with consideration for the neighbours.
- Damaged or faulty equipment must not be used. The Client reports the fault to the Operator by email or phone, ideally with a photo and, if possible, while the Booking is still in progress.
- In the event of an accident or emergency, call the emergency number 112 first, then notify the Operator. A first-aid kit and emergency instructions are kept at the entrance to the Room.
- The Client does not leave valuables in the Room. The Operator is liable for the Client’s belongings under the general rules of law.
§8. Health and safety
- Everyone in the Room trains at their own risk, assessing their own health, skills and choice of loads. The Operator recommends a medical check-up before starting training and using a spotter for heavy lifts.
- The Client informs Companions of these Terms before they enter the Room.
- When creating an account, the Client declares that their health allows them to do strength and endurance training unsupervised. If in doubt, the Client consults a doctor before training.
- The price of a Booking does not include accident insurance. The Operator recommends that everyone who trains has their own personal accident (NNW) insurance.
- The Operator is not liable for damage caused solely by a breach of these Terms, equipment instructions or safe-training rules by the Client or Companions, by the actions of third parties for whom the Operator is not responsible, or by force majeure — unless the Operator contributed to the damage.
- If the injured party contributed to the damage occurring or increasing, the obligation to compensate is reduced accordingly (Art. 362 of the Polish Civil Code).
- The above provisions do not exclude or limit the Operator’s liability for personal injury, for damage caused intentionally or through gross negligence, or in any other respect where the law does not permit this.
§9. Liability for damage
- The Client is liable, under the general rules of law, for damage to the Room and equipment caused by them or their Companions — in the amount of the actual loss.
- The Client reports damage to the Operator by email, ideally with a photo, by the end of the day on which they noticed it. To establish what happened, the Operator may use CCTV recordings and the door-opening log.
- The Operator does not impose contractual penalties on consumers — the Client covers only the documented cost of repair or replacement.
§10. CCTV
- The entrance and the training room are covered by video surveillance without audio recording. The changing room and toilet are not monitored.
- Recordings are kept for 14 days or, if an incident occurs, until it has been resolved. Details are in the Privacy Policy.
§11. Account suspension
- The Operator may suspend the ability to make bookings in the event of a serious breach of these Terms, in particular: sharing the code with third parties, letting in people who are not allowed to use the Room, deliberately damaging equipment, or repeatedly overstaying a Booking.
- The Operator informs the Client of the suspension and the reason for it by email. Paid Bookings cancelled as a result of the suspension are refunded, unless the breach concerned that Booking.
- While suspended, the Client has no access to the VIP services (§6d(2)).
§12. Complaints
- Complaints can be sent by email to biuro@maxigym.pl. A complaint should include the Client’s details, the booking date and a description of the problem.
- The Operator responds to a complaint within 14 days. If it does not respond within that time, the complaint is deemed accepted.
- A Client who is a consumer may use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman.
§13. Personal trainers running a business
- A trainer who books the Room as part of their business is responsible for their clients in the same way as the Client is for Companions, and makes sure their clients have read these Terms.
- The trainer holds valid third-party liability insurance for their business and provides proof of it at the Operator’s request.
- Detailed terms of regular cooperation (fixed slots, billing, invoices) may be set out in a separate agreement.
§14. Final provisions
- The Operator may amend these Terms for important reasons: changes in the law, changes in how the Room or the booking system operates, price changes, or the need to ensure safety. Changes are announced on the website and by email at least 30 days before they take effect; a Client who does not accept them may delete their account during that time. Changes do not apply to bookings already paid for.
- Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
